District Court Orders FDA to Publish FSMA Regulations

A federal judge at the U.S. District Court of Northern California recently ruled the U.S. Food and Drug Administration (FDA) must publish all final regulations in the Federal Register no later than June 30, 2015.  These new food safety regulations are mandated by the Food Modernization Act.  In addition, the FDA must publish all proposed regulations by November 30, 2013 and close of the comment period shall be no later than March, 31, 2014.  The FDA has missed several deadlines for writing of the FSMA mandated rules, thus the Center for Food Safety (CFS) filed a suit against the FDA in August 2012.  In a press release, George Kimbrell, CFS senior attorney, commented, “This is a critical victory for consumers, farmers, and the public health.  The Court’s decision will ensure FDA cannot unduly delay these life-saving measures any longer, while also ensuring all interested parties have a meaningful say in their outcome.”
