DC Appeals Court Orders Review of COOL Judgment

The U.S. Court of Appeals for the District of Columbia Circuit announced that it will review a case that asserts U.S. Department of Agriculture’s (USDA) Country of Origin Labelling (COOL) regulations violate First Amendment rights.  Although last week the Court affirmed the lower court’s ruling, today the Court ordered the case be reviewed en banc, with briefs due on April 18, 2014, and oral argument scheduled for May 19, 2014.
