New House Bill Would Give CBP Authority to Investigate Evasion of AD/CV Duties

Representative Linda Sanchez introduced the Enforcing Orders and Reducing Customs Evasion (ENFORCE) Act of 2010 (H.R. 6549) in the House on December 17, 2010. The bill aims to eliminate evasion of antidumping and countervailing duty payments. ENFORCE would shift certain authority from the Department of Commerce, which currently administers antidumping and countervailing duty orders, to U.S. Customs and Border Protection (CBP). This Act would grant CBP the authority to investigate CV/AD duty evasions. It would also allow domestic producers to petition CBP to investigate possible AD/CV evasions.

H.R. 6549 has been referred to the House Ways and Means Committee and is expected to be reintroduced in the next Congressional session, given the limited time remaining in the current congressional session. The Senate introduced a closely related bill, S. 3725, on August 5, 2010.
