More Children's Products to Require 3rd Party Testing Starting Feb. 10th

The Consumer Product Safety Commission (CPSC) has announced that on February 10, 2010 it will lift its stay of enforcement for the third party testing requirements on the following children’s product safety rules:

  • Bicycle helmets subject to the requirements described at 16 CFR part 1203;
  • Bunk beds subject to the requirements described at 16 CFR part 1513;
  • Rattles subject to the requirements described at 16 CFR parts 15010, 1500.18(a)(15) and 1500.86(a)(1); and
  • Dive sticks subject to the  requirements described at 16 CFR parts 1500.18(a)(9) and 1500.86(a)(7) and (a)(8).

After February 10, 2010, importers must certify, based on testing conducted by a CPSC-recognized third party assessment body, that the products above meet the appropriate standards.

Shipments of subject products without certificates of conformity may be refused entry or destroyed by CPSC or U.S. Customs and Border Protection (CBP) officials after their respective effective dates. Further, the importer of record or consignee may be assessed civil penalties of up to $1.5 million dollars.
