Brazil Releases List of U.S. Origin Goods that could be Subject to Retaliatory Tariffs in Connection WTO Cotton Dispute

On November 7, 2009, Brazil’s Chamber of Foreign Trade published a list of U.S. products that could be subject to retaliatory sanctions in connection with the World Trade Organization’s (WTO) U.S. Cotton Dispute. Two-thirds of preliminary list targets agricultural and consumer goods, including fruits, electronic goods, medical products, and automobiles, among other things. The remainder of the list targets intermediate goods that are used in the manufacture of other products.

In August, the WTO authorized Brazil to impose these counter-measures in response to Washington’s continuing failure to bring its cotton subsidy program into WTO compliance. In its ruling, the WTO laid out a complicated formula in which Brazil’s level of retaliation may very each year (depending on the amount of U.S. subsidies paid to its cotton producers and the effect of those subsidies on Brazil). If the level of retaliation exceeds a certain threshold for any given year, the WTO further authorized Brazil to cross-retaliate by breaking U.S. patents and trademarks.

For 2009, Brazil is estimating the total level of retaliation to be around $900 million, far above the threshold required for cross-retaliation. Brazil expects to impose about half the retaliatory sanctions by suspending tariff concessions and to cross-retaliate with the second $450 million.

Brazil is accepting public comments on the list of items it is proposing to suspend tariff concessions on (and imposing 100% ad-valorem punitive tariffs on), until November 30, 2009. Brazil is expected finalize the list by mid-December, and could possibly begin imposing the new tariffs by January 2010.
