USTR Initiates First Phase of U.S.–E.C Beef Hormones Deal, Requests Comments

The Office of the United States Trade Representative published a notice today regarding the implementation of the first phase of U.S. obligations under Memorandum of Understanding (MOU) with the European Communities (EC) in the beef hormones dispute. According to the MOU, during the first phase the EC will open a new, duty-free 20,000 metric ton tariff rate quota (TRQ) for high-quality beef and in exchange, the U.S. will not modify the list of retaliatory duties on certain EC products that has been in effect since March 23, 2009.

Modifications to the list of products and countries subject to additional duties in connection to the dispute were scheduled to go into effect August 15, 2009. However, rather than cancel these modifications, as called for in the MOU, today’s notice delay’s any action for roughly one month, to September 19, 2009.

In the meantime, USTR is planning to take additional steps in order to continue implementing U.S. obligations under the MOU. Additionally, during this period, USTR will accept comments on all matters at issue, including the continued application of 100% duties on certain products during the first phase of the MOU.
