EU Raises Duties to Offset Byrd Amendment Distributions

The European Union recently announced the imposition of an ad valorem duty of 26% additional to the customs duty to be imposed on four products imported from the United States. According to the EU Commission’s Implementing Regulation, the retaliatory tariffs are “a result of the United States’ failure to bring the Continued Dumping and Subsidy Offset Act (CDSOA) in compliance with its obligations under the WTO agreement”. The change in the retaliatory tariff rate is designed to reflect recent CDSOA disbursement levels. The additional duties apply to products classified under the following Combined Nomenclature (CN) Codes: 0710 40 00, 9003 19 30, 8705 10 00, 6204 62 31. The increased tariff rates applied as of May 1, 2013.

Product Descriptions 0710 40 00:                

Vegetables (uncooked or cooked by steaming or boiling in water), frozen: Sweetcorn

9003 19:                     

Frames and mountings for spectacles, goggles or the like, and parts thereof: Frames and mountings: Of other materials

8705 10:                     

Special purpose motor vehicles, other than those principally designed for the transport of persons or goods (for example, breakdown lorries, crane lorries, fire fighting vehicles, concrete-mixer lorries, road sweeper lorries, spraying lorries, mobile workshops, mobile radiological units): Crane lorries

6204 62 31:    

Women's or girls' suits, ensembles, jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of Cotton: Trousers and breeches: Of denim
