CAFC Rules on Steel Coiled Rod

    On September 22, 2014, the U.S. Court of Appeals for the Federal Circuit (CAFC) ruled that A.L. Patterson, Inc.’s steel coiled rod does not fall under the scope of the antidumping duty order on steel threaded rod from China.  This decision overturns the Department of Commerce’s decision that included the product under antidumping order and subjected imports of the product to additional duties.  The Court held that coil rod was a distinctly different product from steel threaded rod and found insufficient evidence to conclude that coil rod was part of the domestic industry investigated by the U.S. International Trade Commission in the original investigation.
