Court of Appeals for the Federal Circuit Rules Against IEEPA Tariffs

Friday afternoon the Court of Appeals for the Federal Circuit (CAFC) released an opinion ruling that the IEEPA tariffs exceed the President's authority. The court also sent the question of whether an injunction is appropriate back to the CIT.

The practical impact of the decision is that (a) there will be an appeal to the Supreme Court of the United States, and (b) that the duties will continue to be collected for the foreseeable future. Nevertheless, the fact that two courts have ruled that the IEEPA tariffs exceed the scope of the law is a (potentially) hopeful sign for an eventual Supreme Court decision.
