Day 1 Trade Actions Have No Tariffs but Lots of (Potential) Impact

While President Trump’s campaign pledges to impose tariffs on day 1 did not materialize, there were significant actions that will impact trade. The President issued a memorandum ordering the Department of Commerce, the Secretary of the Treasury, and the United States Trade Representative (“USTR”), in consultation with other agencies such as the Department of Homeland Security, to conduct numerous reviews or investigations addressing trade issues discussed on the campaign trail. These reports are all to be delivered by April 1, 2025, potentially indicating that actions are not planned in the interim.
Areas that the memorandum requested information about include trade agreements, trade with China, United States trade deficits with trade partners, the application of Section 232, AD/CVD laws, de minimis import rules, and securing the border against drug shipments. The memorandum also included sections about export controls and the potential establishment of an External Revenue Service. These requests implicate a broad array of existing, but largely dormant, U.S. trade laws. All could be potential bases for trade actions.
