DDTC Amends ITAR Registration Timeframes

The State Department’s Directorate of Defense Trade Controls (DDTC) has issued a final rule amending the International Traffic in Arms Regulations (ITAR) timeframes for registration and renewal at 22 CFR § 122.3

The final rule, effective July 18, 2008, amends 22 CFR § 122.3 to limit the registration period to one year (instead of two years) for both new registrants and for those renewing registration for manufactures, exporters and brokers of defense articles. Those renewing their registration will also be required to submit renewal packages no more than 60 days prior to their current expiration date.

Specifically, 22 CFR 122.3(a) and (b) are amended as follows: (changes underlined):

  • A person who is required to register may do so for a period of 1 year of 1 year upon submission of a completed Form DS-2032, transmittal letter and payment of $ 1,750
  • A registrant must submit its request for registration renewal at least 30 days but no earlier than 60 days prior to the expiration date.

All manufacturers, exporters, and brokers of defense items as defined on the U.S. Munitions List of the ITAR (USML), are required to register with DDTC. Although DDTC does not confer any export rights or privileges, registration is a precondition for the issuance of any license or other approval of for export.
