Long-Awaited Brazil 301 Duties Issued

For a year U.S. companies trading with Brazil have been waiting for the Section 301 case against Brazil to be finalized. Now, at the last possible (legal) moment in the investigation, the United States Trade Representative has published a notice that will be placed in the Federal Register (probably by around July 17 or July 20).

The new Brazil tariffs will begin for goods entered for consumption or withdrawn from warehouse on or after 12:01 a.m. eastern time on July 22, 2026. There is a window for “goods on the water” that are loaded prior to July 22 and enter the United States before 12:01 a.m. eastern time on July 29. In addition, articles properly entered under Chapter 98 will either be exempt from the duty or will need to comply with special calculations (as has been true for most Trump tariffs). There are also exclusions for aviation articles and articles used in pharmaceutical applications, as well as an extensive list of excluded tariff provisions.

Significantly for many importers from Brazil, the new Section 301 duties do not apply if Section 232 duties apply. Therefore, imports of Section 232 steel, aluminum, copper, passenger vehicles and parts, wood products, medium and heavy vehicles and parts, and semiconductor articles are all exempt from these duties.

The remaining articles from Brazil will face a 25% duty, as well as the underlying duty.
