The White House announced changes to Section 338 tariffs on Canadian goods, effective 12:01 a.m. ET on October 30. According to the corresponding White House fact sheet, these changes are "to continue effectively offsetting the burden to U.S. commerce while better serving the public interest.”

The revisions remove several products subject to a 50% tariff, including plywood, certain paper products, machinery, refrigeration equipment, and packaging materials, while adding new categories such as cocoa powder, paint, shampoo, flooring, paper bags, freezers, and some medical equipment to the 50% tariff list.

The White House said the changes were made in the public interest and cited the Trade Act of 1974 as the legal basis for modifying the tariffs within the 30-day window allowed under Section 338.

Meanwhile, importers are challenging President Trump’s tariffs imposed under Section 338, arguing that the tariffs had been “impliedly repealed” by subsequent legislation that culminated in Section 301.
