Antidumping Duty Investigation No. 731-TA-433 and Countervailing Duty Investigation No. 701-TA-1029 regarding Allura Red from India were filed March 4, 2003. Petitioners request the imposition of antidumping and countervailing duties on the subject merchandise from India.

Petitioners estimate that the dumping margins for imports from the target country are at least two hundred eighty-five percent (285%).

DESCRIPTION OF MERCHANDISE

Merchandise included in the petition is Allura Red from India. The subject merchandise is a synthetic red food coloring referred to as FD&C Red No. 40 in all forms and variations, including powder, press cakes, extrudates, liquid, and granules, except lake pigments and colors of animal, vegetable, or mineral origin. Allura Red is commonly used in such products as soft drinks, baked goods, pet foods, and pharmaceutical tablets.

The subject merchandise is imported under HTSUS Subheading 3204.12.5000. The Government of India classifies Allura Red under Indian Exim Code 3204.12.13.
